Agreement: By accessing or using the CastVerse platform (the "Service"), you agree to be bound by these Terms of Service (ToS), our Privacy Policy, and any other posted guidelines. If you do not agree to these terms, you may not use the Service.

Eligibility: You must be at least 18 years of age to create an account. If you are a minor, your account must be created and managed by a verified parent or legal guardian who agrees to these terms on your behalf.

User Roles: You acknowledge that these terms may apply differently based on your designated role on the platform, including but not limited to "Talent," "Casting Director/Project Poster," and "Crew/Freelancer."

Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

Identity Verification: You acknowledge and agree that certain platform features, such as receiving a "Verified" badge or accessing advanced posting privileges, may require you to submit additional information for identity verification (e.g., via IMDbPro sync, government ID, or company registration documents).

Prohibited Use: You may not share your account credentials with any third party. Unauthorized commercial use of the platform, including data scraping or use by competing services, is strictly prohibited and will result in immediate account termination.

Ownership: You retain full ownership of all intellectual property rights in and to the content you upload to the Service, including but not limited to your headshots, reels, voice samples, and scripts ("Your Content").

License to CastVerse: You grant CastVerse a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, modify (for formatting purposes), and distribute Your Content solely for the purposes of operating, developing, and providing the Service. This includes displaying your profile to casting professionals and for internal platform analysis to power features like role matching.

Platform Training & Data Use: You grant CastVerse explicit permission to use anonymized and aggregated data (e.g., submission success rates, role viewing times, successful profile attributes) to train and improve the platform's proprietary matching, analytics, and recommendation systems. We guarantee that your personally identifiable media (reels, voice samples, headshots) will not be publicly licensed or sold to third parties for external model training or any purpose outside of the platform's intended casting and hiring functions.

Representations & Warranties: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions for all content you upload. You further warrant that Your Content does not and will not violate any third-party rights, including copyright, trademark, privacy, or rights of publicity.

Zero-Tolerance Policy: CastVerse maintains a zero-tolerance policy for harassment, discrimination, hate speech, fraudulent activity, and any illegal content or behavior. Violation of this policy will result in immediate account termination and potential reporting to law enforcement.

Casting Call Integrity: For Project Posters/CDs, you agree to mandatory, transparent disclosure of compensation terms (e.g., paid, deferred, expenses-only). You are prohibited from soliciting illegal content, non-standard audition requests (e.g., requests for payment to audition), or engaging in exploitative practices.

Vetting System: You acknowledge that CastVerse reserves the right to review, reject, or remove any content, user, or casting call at our sole discretion, particularly those flagged by our automated Scam/Spam Guard, to maintain the safety and integrity of the ecosystem.

Privacy & Communication: The in-app messaging system is for professional communication related to projects on the platform. You are strictly prohibited from exporting contact information for unsolicited marketing or misusing personal data obtained through the Service.

Pricing: Subscription fees for premium features, such as advanced Casting Director tools, are detailed on our Billing page. All fees are due in advance and are non-refundable except as explicitly stated in our Refund Policy.

"Free for Talent" Principle: Our core commitment is to the talent. All Talent and Crew profiles have the ability to create a profile and submit to casting calls for free, without any hidden fees or commissions on bookings.

Refund Policy: Details regarding subscription cancellations and refunds are available on our FAQ and Billing pages. Generally, prepaid subscriptions are non-refundable for the current term.

Disclaimer of Endorsement: CastVerse facilitates connections but does not endorse any specific Talent, Casting Director, or project. Users are solely responsible for their own due diligence, interviews, and contractual agreements.

"As Is" Service: The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability: To the fullest extent permitted by applicable law, CastVerse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your access to or use of the Service.

Governing Law: These Terms of Service and any dispute arising out of or related to them or the Service shall be governed by the laws of the State of Delaware, without regard to its conflict of laws rules.

Dispute Resolution: You agree to first attempt to resolve any disputes with CastVerse informally. If a dispute is not resolved informally, you agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms by binding arbitration. The arbitration will be conducted in Wilmington, Delaware, unless you and CastVerse agree otherwise.

Class Action Waiver: All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class action, collective action, private attorney general action, or other representative proceeding. This waiver applies to class arbitration, and, unless we agree otherwise, the arbitrator may not consolidate more than one person's claims.

Termination by User: You may terminate your account at any time through your account settings. Upon termination, your profile and data will be scheduled for deletion in accordance with our Privacy Policy.

Termination by CastVerse: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any conduct that we believe violates these ToS, is harmful to other users, or is otherwise detrimental to the Service.

Notification: We may revise these Terms of Service from time to time. The most current version will always be posted on our website. For material changes, we will notify you through the Service or by email to the address associated with your account.

Continued Use: By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
