This policy describes the procedures CastVerse adheres to for processing notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

II. Notice of Infringement (Takedown Notice)

This section details the formal legal requirements for a copyright holder (the "Claimant") to properly submit a complaint requesting the removal of infringing content. A valid notice must include the following:

  • Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of the copyright interest.
  • Identification of the Copyrighted Work: A description of the copyrighted work claimed to have been infringed (e.g., the specific headshot, reel footage, script, or musical track).
  • Identification of the Infringing Material: A description and specific URL link on the CastVerse platform where the material claimed to be infringing is located. (General descriptions are insufficient).
  • Contact Information: Claimant's name, address, telephone number, and email address.
  • Good Faith Statement: A statement that the Claimant has a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement (Under Penalty of Perjury): A statement that the information in the notification is accurate, and under penalty of perjury, that the Claimant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important: Incomplete or invalid notices will not be processed. Knowingly making a material misrepresentation that content is infringing may subject you to liability for damages.

III. Counter-Notice Procedure

This section outlines the process for a CastVerse user (the "Respondent") to dispute a takedown notice, asserting that the material was removed or disabled as a result of mistake or misidentification. A valid counter-notice must include:

  • Physical or Electronic Signature: The signature of the Respondent.
  • Identification of Removed Material: A description of the material that has been removed and the specific URL where the material appeared before its removal.
  • Good Faith Statement (Under Penalty of Perjury): A statement that the Respondent has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction: The Respondent's name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district where the address is located (or any district where CastVerse may be found if outside the U.S.).
  • Acceptance of Process: A statement that the Respondent will accept service of process from the person who provided the original DMCA notice.

Takedown Reversal: Upon receipt of a valid counter-notice, CastVerse will forward a copy to the original Claimant. The removed content may be reinstated within 10 to 14 business days unless our Designated Agent is notified that the Claimant has filed a court action seeking an order to restrain the user from engaging in the infringing activity.

IV. Repeat Infringer Policy

To maintain DMCA safe harbor protection, CastVerse has a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

  • Definition: A "repeat infringer" is a user for whom CastVerse has received two or more valid and un-retracted DMCA Takedown Notices.
  • Action: CastVerse reserves the right, in appropriate circumstances and at its sole discretion, to terminate the accounts of users who are determined to be repeat infringers.

CastVerse reserves the right to modify the terms of this policy at any time. The most current version will always be posted on this page, and we encourage users to review it periodically.
